When it comes to disputes in the maritime and shipping sector; you need to be prepared for conflicts. Unexpected challenges may arise, like accidents which can create complex challenges. But also the change of ownership of the vessel can create serious challenges, when the vessel or cargo is still between ports.
Time spent in ports should be as planned and efficient as possible to get the most benefit from owning ships or chartering. Ships earn their living by transporting cargo from port to port, not by being in port loading or unloading cargo.

Dept Collection
If you have problems collecting outstanding bills and invoices in Turkey, the Netherlands, United Kingdom etc., you need the help of an attorney.
The starting point is always to start the collection out of court. It is important to maintain good contact with the debtor in order to reach a settlement. Litigation is of course expensive, but it can also take a very long time. The first step is always to contact the debtor to ensure that the payment follows quickly. According to Turkish-, Dutch- and English law, the debtor must be officially informed of your claim and the statutory interest. This notice is drawn up by an attorney.
In Turkey it works as follows; the notice of default must then be registered by the notary. The notice of default is drawn up in triplicate, one for you, one for the notary and one for the debtor. After registration, a copy is served to the debtor. We will then contact the debtor by telephone with a request for payment. In most cases, it works for Turkish debtors if a payment arrangement is made. In the Netherlands or UK, the notary is not involved. The announcement before the start of legal proceedings usually ensures that the debtor makes the payment after all.
In the event that we need to start legal collection proceedings, it is important to know which court is competent and which law will apply. The parties and the agreement are leading. It may be agreed in the agreement which court has exclusive jurisdiction to hear a dispute. This is called a forum selection. If no choice of forum has been made, the main rule is that the court in the country of the defendant has jurisdiction.

Goods can get damaged, can arrive late or do not arrive. It can also happen that some kind of goods need special care during the transport, because of its value.
